Ideology

A belief question

When a court rules that a law conflicts with a Basic Law, who should have the final say?

Basic Laws are laws the Knesset passed on how the state is governed and on basic rights. The Supreme Court has held that they rank above ordinary laws. One way to give elected lawmakers the final say is an override clause, which lets the Knesset keep a law in force despite such a ruling.

The two sides

  • The court, and the law does not stay in force
  • Elected lawmakers, who can keep the law in force
